How we protect your EB-5 investment
Every EB-5 project inherently comes with four key risks: Construction risk, Financing risk, Green Card risk, and Operational risk. We filter projects through an extensive set of parameters during our due diligence process to assess the project's management of these four key risks. Here are some of our key project due diligence requirements.
Construction
All government entitlements and permits must be in place and the project must either already be under construction or, in some cases, shovel ready with imminent start of construction.
Financing
All financing must be in place and the project / developer must demonstrate the ability to complete construction without dependence on EB-5 funds.
Green Card
Minimum of 14 jobs per investor. A majority of the jobs must come from construction activity alone, or from operational revenue that is already locked in with binding customer agreements.
Operations
The project must demonstrate a minimum debt service coverage ratio, including EB-5 and all other debt, of at least 1.2. The project must demonstrate a clear path to repayment of EB-5 capital through either refinance, sale, or cash flow from operations through a reputable third-party appraisal and/or exit analysis.

Yes. If you file Form I-485 (Adjustment of Status) while your EB-5 category is current, you can receive an Employment Authorization Document (EAD) and Advance Parole (AP). If visa retrogression occurs afterward, your application remains pending, and you can continue renewing your EAD and AP until your green card is approved.
