They were very thorough and answered all of my questions timely and transparently, which built a strong foundation of trust. Investments like this are a big commitment for any individual or family and naturally come with a fair amount of uncertainty and anxiety, but they were patient and took the time to walk through details, ensuring I felt comfortable and well informed throughout the process. I appreciated their professionalism and the care they took in maintaining open communication.

EB-5 Investor
We had a wonderful experience with EB-5 Visa Investors when our family applied for the EB-5 immigration visa years ago. They made sure we understood all the offering documents. The team responded to our inquiries/calls immediately, coordinated with attorneys and project owners, oversaw the whole process until the permanent green card was received and principal was repaid. We were so impressed by their professionalism, and we always would love to refer them to our friends.

How we protect your EB-5 investment
Every EB-5 project inherently comes with four key risks: Construction risk, Financing risk, Green Card risk, and Operational risk. We filter projects through an extensive set of parameters during our due diligence process to assess the project's management of these four key risks. Here are some of our key project due diligence requirements.
Construction
All government entitlements and permits must be in place and the project must either already be under construction or, in some cases, shovel ready with imminent start of construction.
Financing
All financing must be in place and the project / developer must demonstrate the ability to complete construction without dependence on EB-5 funds.
Green Card
Minimum of 14 jobs per investor. A majority of the jobs must come from construction activity alone, or from operational revenue that is already locked in with binding customer agreements.
Operations
The project must demonstrate a minimum debt service coverage ratio, including EB-5 and all other debt, of at least 1.2. The project must demonstrate a clear path to repayment of EB-5 capital through either refinance, sale, or cash flow from operations through a reputable third-party appraisal and/or exit analysis.
Frequently Asked Questions
Find answers to common questions about the EB-5 process and investment safety.
An EB-5 investment typically involves several key entities: the New Commercial Enterprise (NCE), which raises investor capital; the Job Creating Entity (JCE), which uses the funds to develop the project; the USCIS-approved Regional Center, which oversees compliance and job creation modeling; and a third-party EB-5 fund administrator, which tracks investor funds and expenditures. Each party plays a critical role in both the immigration process and investment structure. READ MORE: https://www.eb5visainvestors.com/nce-vs-jce-eb5
Yes. If you file Form I-485 (Adjustment of Status) while your EB-5 category is current, you can receive an Employment Authorization Document (EAD) and Advance Parole (AP). If visa retrogression occurs afterward, your application remains pending, and you can continue renewing your EAD and AP until your green card is approved. There is no such thing as a completely “safe” EB-5 investment, as all EB-5 projects carry both immigration risk and financial risk. However, investors can reduce risk by selecting projects sponsored by experienced EB-5 Regional Centers with a proven track record*, strong capitalization, and a well-structured business plan.Key factors to evaluate include the capital stack, job creation methodology, developer experience, and exit strategy. Many investors also prioritize rural TEA projects or projects with significant non-EB-5 equity, as these may offer additional protections.Conducting thorough EB-5 due diligence—ideally with the guidance of an immigration attorney and financial advisor—is essential before making an investment decision. There are two primary EB-5 investment options:
- Direct EB-5 requires investors to actively manage a business and create at least 10 full-time U.S. jobs directly.
- Regional Center EB-5 allows for a more passive investment, where job creation can include indirect and induced jobs calculated through economic models.
Most investors choose the Regional Center program due to its flexibility and scalability for meeting job creation requirements. READ MORE: https://www.eb5visainvestors.com/what-is-direct-eb-5
EB-5 investments are not guaranteed, but many projects are structured with a defined exit strategy to return investor capital. Repayment depends on factors such as project performance, capital stack structure, and loan terms. It’s important to understand that USCIS does not guarantee financial returns—its role is limited to adjudicating immigration petitions like the I-526E and I-829. The EB-5 visa process involves several steps:
- Make a qualifying EB-5 investment
- File Form I-526E (Immigrant Petition by Investor)
- Upon approval, apply for conditional permanent residency (green card)
- After approximately two years, file Form I-829 to remove conditions
This process ultimately leads to a permanent green card, and later eligibility for U.S. citizenship. READ MORE: https://www.eb5visainvestors.com/eb5-visa-investment
Yes, EB-5 investors may use loan proceeds, but the loan must be secured by the investor’s personal assets, such as real estate or other owned property. USCIS requires that the investor be personally liable for repayment, and unsecured loans generally do not qualify. Always consult an experienced EB-5 immigration attorney before structuring your source of funds. READ MORE: https://www.eb5visainvestors.com/eb5-loan
The current EB-5 investment thresholds are:
- $800,000 for projects located in a Targeted Employment Area (TEA), including rural EB-5 projects
- $1,050,000 for non-TEA investments
These amounts were updated under the EB-5 Reform and Integrity Act of 2022 and may be adjusted periodically.Other EB-5 costs include administrative fees, legal fees, USCIS filing fees, and more. READ MORE: https://www.eb5visainvestors.com/eb5-investment-amount
EB-5 investors become eligible to apply for U.S. citizenship (naturalization) after holding a green card for five years. This timeline begins once permanent residency is granted, including time spent in conditional status. Certain exceptions may apply, such as marriage to a U.S. citizen.
